In her official capacity as Director of National Intelligence, Tulsi Gabbard has submitted a criminal referral to the Department of Justice, urging prosecutors to investigate Barack Obama and several senior intelligence officials for what she describes as a “treasonous conspiracy” to delegitimize President Donald Trump.

The criminal referral stems from a trove of over 100 pages of declassified documents and internal memos. According to Gabbard, these materials prove that the Obama administration knowingly manipulated intelligence to push a false narrative about Russian interference favoring Trump in the 2016 election.

Gabbard’s claim centers on a December 9, 2016, meeting where she alleges Obama directed key intelligence figures to alter earlier assessments. Those prior assessments had concluded that Russia attempted to meddle in the election but did not tamper with voting systems and had no proven preference for Trump.

She argues that this crucial nuance was buried, overwritten by a narrative suggesting that Trump’s victory was the product of Russian espionage and collusion—claims now thoroughly discredited. “In my view, we have the evidence to be able to move forward and bring about justice, yes, to prosecute and indict those responsible,” Gabbard said in a public statement.

Among the officials named in her referral are former CIA Director John Brennan, former FBI Director James Comey, and former Director of National Intelligence James Clapper. These individuals were at the center of the intelligence apparatus during the transition between Obama and Trump.

Gabbard contends that these men, under Obama’s direct orders, suppressed dissenting assessments and crafted the now-infamous Intelligence Community Assessment (ICA) that was used to justify years of politically weaponized investigations against Donald Trump.

In response to her referral, Attorney General Pam Bondi has assembled a DOJ “strike force” composed of prosecutors and national security experts. Their task is to comb through the documents and determine whether any of the individuals named violated federal law.

Bondi has stated the team is investigating a range of potential charges, including conspiracy, obstruction of justice, abuse of power, mail and wire fraud, and making false statements to federal investigators and Congress.

Gabbard’s findings also implicate former National Security Adviser Susan Rice and then-Vice President Joe Biden, who allegedly were briefed on and supported the shift in intelligence narratives, fully aware that the claims lacked verification.

President Trump has vocally supported Gabbard’s move, calling her findings “irrefutable evidence of the greatest political crime in American history.” He added, “It’s time to go after people. Obama’s been caught directly. This was treason.”

Conservative lawmakers have quickly rallied behind Gabbard. Senators Lindsey Graham and John Cornyn have called for the appointment of a special counsel to ensure a thorough and unbiased investigation of the Obama-era intelligence operations.

House Oversight Chairman James Comer announced he will subpoena several individuals named in the referral. “This cannot be swept under the rug. The American people deserve answers about how their government was weaponized against a duly elected president,” Comer declared.

Some intelligence veterans have called the revelations the most damning indictment of politicized intelligence in decades. One former FBI agent told the press, “This is bigger than Watergate. The manipulation of intelligence to take down a political opponent is an assault on democracy.”

However, the mainstream media has either ignored the story or attempted to discredit Gabbard. CNN and MSNBC have labeled her a conspiracy theorist, despite her current position as the nation’s top intelligence official and the declassified nature of her evidence.

Democratic lawmakers have responded with outrage. Senator Mark Warner accused Gabbard of “peddling dangerous disinformation” and dismissed her referral as “baseless and politically motivated.”

Others have clung to the discredited Steele dossier narrative, refusing to acknowledge that multiple investigations, including the Mueller probe, failed to establish collusion between the Trump campaign and Russia.

Fact-checking organizations have scrambled to downplay Gabbard’s referral, asserting that changes in intelligence assessments were normal and reflected evolving evidence. But critics say this misses the point—that the assessments were altered to serve political ends.

What Gabbard has laid bare is a pattern of deceit. Intelligence assessments that once concluded no preference or vote tampering were manipulated to create a pretext for surveillance and investigation of Trump associates.

This manipulation fueled a media frenzy, led to multiple criminal probes, and severely damaged public trust in both the presidency and the intelligence community. Now, Gabbard is demanding that those responsible be held to account.

Her move is courageous and historic. No senior intelligence official has ever referred a former president and his inner circle for criminal prosecution based on internal government records. Gabbard is charting new territory in pursuit of justice.

The move also signals a broader shift in the intelligence community, which under Gabbard’s leadership is seeking to restore its credibility and independence after years of politicization under liberal administrations.

The political ramifications are enormous. With Trump surging in polls ahead of 2024 and grassroots conservatives energized, Gabbard’s referral could reshape the national conversation heading into the election.

It also raises serious questions about Joe Biden’s involvement, given his participation in high-level briefings at the time. Republicans are already signaling they intend to follow the trail wherever it leads, including the current Oval Office.
